By accessing or using the PapaFoody mobile application, website, or any of our services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services. These terms apply to all users, including customers, delivery partners, and restaurant partners.

2. Description of Services

PapaFoody is a food delivery platform that connects customers with local restaurants across Pakistan. Our Services include:

• Online food ordering through our mobile app and website
• Real-time order tracking and delivery status updates
• Secure payment processing (cash on delivery and online payments)
• Customer support services
• Restaurant partner management platform
• Delivery partner mobile application

3. Account Registration

To use certain features of our Services, you must register for an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized account use

You must be at least 18 years old to create an account and use our Services.

4. Orders and Payments

When placing an order through PapaFoody:

• All prices are displayed in Pakistani Rupees (PKR) and include applicable taxes
• Delivery fees are calculated based on distance and displayed before checkout
• Orders are subject to availability and restaurant acceptance
• We accept cash on delivery and various online payment methods
• Once an order is confirmed, cancellation policies apply
• Refunds are processed according to our refund policy

5. Delivery Terms

Regarding food delivery:

• Estimated delivery times are approximate and may vary
• Delivery is subject to weather conditions and traffic
• You must provide accurate delivery address and contact information
• Someone must be available to receive the order at the delivery location
• PapaFoody is not responsible for delays caused by incorrect addresses
• Special delivery instructions should be provided during checkout

6. User Conduct

When using our Services, you agree not to:

• Use the Services for any unlawful purpose
• Harass, abuse, or harm delivery partners or restaurant staff
• Provide false information or impersonate others
• Interfere with or disrupt the Services
• Attempt to gain unauthorized access to our systems
• Use automated systems to interact with our platform without permission
• Engage in fraudulent activities or false claims

7. Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of PapaFoody or its licensors and are protected by Pakistani and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written consent.

8. Restaurant Partner Terms

For restaurant partners using PapaFoody:

• Restaurants are responsible for food quality and safety
• Menu items and prices must be accurate and up-to-date
• Orders must be prepared within the specified time
• Commission rates and payment terms are as per the partnership agreement
• Restaurants must maintain valid food licenses and certifications

9. Delivery Partner Terms

For delivery partners (riders):

• Must have a valid CNIC and driver's license (where applicable)
• Must maintain their vehicle in safe working condition
• Must follow all traffic laws and safety guidelines
• Must complete deliveries professionally and courteously
• Payment terms are as per the delivery partner agreement

10. Limitation of Liability

To the maximum extent permitted by law, PapaFoody shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Services. Our total liability shall not exceed the amount you paid for the specific order giving rise to the claim.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the Services shall be governed by the laws of Pakistan. You agree to first attempt to resolve any disputes through our customer support. If resolution cannot be reached, disputes shall be submitted to the exclusive jurisdiction of the courts in Islamabad, Pakistan.

12. Modifications to Terms

PapaFoody reserves the right to modify these Terms at any time. We will notify users of significant changes through the app or email. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.

13. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the Services will immediately cease.
